Regulatory Overview

SunShare Philippines Inc. operates within a comprehensive regulatory framework governing the Philippine electricity sector. Our licenses, registrations, and compliance obligations are overseen by multiple government agencies. This page provides a transparent summary of our regulatory standing.

SunShare is a fully licensed and registered energy company. We maintain all required approvals to operate as a Retail Electricity Supplier and Retail Aggregator under Philippine energy law. Compliance documentation is available to Members and regulators on request.

EPIRA and RCOA Framework

The Electric Power Industry Reform Act (RA 9136), enacted in 2001, restructured the Philippine electricity market from a state monopoly into a competitive system. SunShare was founded specifically to bring the benefits of this reformed market to consumers who previously could not access it individually.

Our role under EPIRA

SunShare operates as a Retail Electricity Supplier (RES) — one of the licensed entities authorized under EPIRA to supply electricity to eligible consumers at competitive rates. We are also licensed as a Retail Aggregator, which specifically allows us to pool smaller consumers into Retail Aggregation Groups (RAGs) that collectively meet the RCOA eligibility threshold.

Retail Aggregation Group (RAG) structure

Aggregation groups organized by SunShare are formally constituted under ERC rules. Each group is registered with the ERC and the relevant distribution utility. Members' rights within the group are governed by their individual Supply Agreements and the RAG agreement, which is submitted to the ERC as part of the registration process.

Rate regulation

While generation supply rates are determined through market competition, all other components of your electricity bill remain under ERC rate regulation. SunShare does not influence or control the distribution, transmission, or universal charge portions of your bill. All rates applied by SunShare are consistent with ERC-approved terms.

Data Privacy Compliance

SunShare is registered with the National Privacy Commission (NPC) under the Philippine Data Privacy Act of 2012 (RA 10173). We maintain a registered Data Protection Officer (DPO) and have implemented privacy-by-design principles across our platform.

NPC registration

Our NPC registration covers the processing of personal data for the purposes of electricity supply service delivery, customer relationship management, regulatory compliance, and platform improvement. Our privacy practices are described in full in our Privacy Policy.

Data handling in energy operations

Consumption data shared between SunShare, distribution utilities, and market operators is handled under data sharing agreements and is subject to applicable confidentiality provisions under ERC rules. Individual consumption data is never disclosed to third parties for commercial purposes without consent.

SunShare undergoes an annual privacy audit to ensure alignment with NPC requirements. Our last audit was completed April 2026 with no material findings.

Consumer Protection

SunShare is committed to fair, transparent, and consumer-protective practices in line with ERC consumer protection rules for retail electricity suppliers.

Transparent pricing

All rates offered by SunShare are disclosed in full before you sign any agreement. We do not impose hidden fees, and our savings projections are clearly labeled as estimates. Your Supply Agreement specifies the exact rate structure, any escalation provisions, and all fee schedules.

No lock-in for residential customers

Residential Members may terminate their Supply Agreement with one billing cycle's written notice, with no penalty. This aligns with ERC consumer protection guidelines that prohibit unreasonable lock-in periods for residential electricity customers.

Dispute resolution

SunShare maintains an internal dispute resolution process available to all Members. If an internal resolution is not reached, Members may escalate to the Energy Regulatory Commission's Consumer Affairs Service (ERC-CAS) or the relevant distribution utility's customer service unit. Contacts:

Renewable Energy and FIT-All

SunShare supports the Philippine government's renewable energy targets under the Renewable Energy Act (RA 9513) and the DOE's National Renewable Energy Program (NREP). Our supply mix includes renewable energy certificates (RECs) to offset carbon associated with grid electricity.

Feed-in Tariff (FIT-All)

The FIT-All surcharge on your electricity bill is a government-mandated universal charge that funds the DOE's renewable energy incentive program. SunShare passes this charge through at cost — we do not mark it up or derive revenue from it.

Phase II Solar integration

SunShare's Phase II service includes structured access to solar generation for aggregated customers. All solar generation arrangements are structured in compliance with ERC rules governing renewable energy supply contracts and net metering/net billing programs.
